Taxi Emin provides services on the basis of the following GTC, the performance descriptions and price lists. Deviating terms and conditions shall not apply, even if Taxi Emin does not expressly object to them. Deviations from these conditions require the express written acknowledgment of Taxi Emin Airport Taxi. A contract shall only be valid if confirmed by Taxi Emin.

Scope of Services

The scope of services is determined exclusively by Taxi Emin written confirmation of order or by subsidiary on Taxi Emins written offer. Information contained in prospectuses, performance catalogues, price lists and similar information is only binding to the extent expressly referred to by these. The transport is carried out according to the provisions of the Road Traffic Regulations and the PbefG. Passengers must comply with instructions from Taxi Emin or from the chauffeur. If passengers do not comply with the directives, or if they constitute a threat to the Road Traffic Regulations or the safety of road traffic due to impairments of the chauffeur, Taxi Emin Airport Taxi is entitled to exclude them from the transport. In this case, Taxi Emin Airport Taxi will charge the full fare, including the fixed price or kilometre price and all additional and special services.

Airport pick-up (airport transfer)

Any change to the agreed pick-up time, for whatever reason, shall be communicated to Taxi Emin Airport Taxi without delay. Damage caused by a non-immediate notification shall be borne by the customer.

Prices

The prices include the statutory value-added tax at the respective statutory rate. The available prices are those from the day of booking confirmation. Prices not listed in the price list can only be agreed in writing and apply only for the agreed date of travel and rental period. Additional times and distances are calculated according to the valid price list. Additional costs due to delays will be charged to the customer, unless the delays are due to a fault of Taxi Emin Airport Taxi or the chauffeur. The price includes the transport of persons with normal luggage; The entrainment of bulky goods requires a separate agreement.

Payment terms

Taxi Emin reserves the right to charge a deposit of up to 100% of the total price before the start of the journey or to demand a blank credit card issued on Taxi Emin prior to the acceptance of an order for a valid credit card. Residual payments are due for payment within the deadlines specified in the invoice. The timely payment shall be subject to the receipt of Taxi Emin’s unrestricted availability. In the case of payment by check, the claim is deemed to be paid only after the final full credit has been credited. Payments are always used to settle the oldest claim. If the customer is in default of payment, Taxi Emin will charge interest of 5 percentage points above the basic interest rate, subject to assertion of further default damages. For the second and each additional reminder, € 10, — dunning fee will be charged. The customer is entitled to prove a lower loss.

Cancellation

Cancellations will be effective only if they are made in writing or confirmed by Taxi Emin in writing. Taxi Emin shall have access to its right of withdrawal in writing. Cancellations up to 24 hours before the scheduled start of the trip are free of charge. In the case of cancellations, Taxi Emin will charge a share of the basic fare as compensation.

This share is:

* 50% for cancellations up to 24 hours prior to the contractually agreed date of performance
* 100% in case of later cancellations and no-show of the trip.

If the customer does not find his chauffeur at the airport or in the city, he is obliged to contact Taxi Emin immediately. In case the customer does not report and the chauffeur cannot find the customer (or vice versa) and therefore the trip does not take place anymore, the trip and if necessary, the waiting time are 100% charged.

Taxi Emin will charge expenditures irrespective of the timeliness of the cancellations, if these have already been incurred. The customer is expressly permitted to prove that Taxi Emin has suffered no or a lower loss. Taxi Emin reserves the right to rescind the contract in whole or in part if the customer ceases to pay, becomes insolvent or, on the basis of external circumstances, assumes that the services are abused, or the customer violates his duty under these terms.

Obligations and liability of the customer

The customer shall immediately notify Taxi Emin of any changes to his name, his (invoicing) address, his legal form and his bank details. Likewise, the customer is obliged to provide the necessary information on passengers, time and place of the service. If the customer fails to provide an immediate notification, he is liable for damages which would have been avoided in the case of timely notification. The customer also binds himself, in the name of the passengers, not to use abusively the service of Taxi Emin, in particular:

* Not to disturb or obstruct the performance of the service
* Not to cause any damage
* Not to violate the penal regulations
* Not to smoke in the vehicle
* Not to refuse to accept the fare.

If a customer violates the aforementioned obligations, Taxi Emin is entitled to take all necessary measures to eliminate the misuse. In the case of culpable infringement, the customer shall be liable for compensation against Taxi Emin.

Liability

Taxi Emin is not liable for any loss of time and its economic consequences. These include, for example delays caused by:

* Traffic jams, road blockages
* Vehicle breakdowns or traffic accidents
* Bad weather, etc.

Taxi Emin shall not be liable to the customer or the passenger for any damages resulting from incorrect transmission of data by the customer.

Applicable law and jurisdiction

For all legal relations between Taxi Emin and its customer the Austrian law applies exclusively. Place of jurisdiction and place of performance is Innsbruck.

Partial ineffectiveness

Should one or more of the above conditions be invalid, the remaining conditions shall remain unaffected.
